The <br />report indicated that the site has been, and may continue to be, <br />inactive for at least six months. Please refer to the <br />Construction Rules and Regulations Sections 1.13 (enclosed) which <br />state that if an operation ceases production for a period of <br />180 days or more, thEa operator must file a Notice of Temporary <br />Cessation with the Board. This notice must state the date of <br />cessation, the reasons for cessation, a plan for the resumption <br />of mining, a description of those activities the operator will <br />take to ensure compliance with the permit reclamation <br />requirements and a description of site maintenance activities to <br />ensure compliance with the perfornLance standards (Rule 3). The <br />Notice of Temporary Cessation should be sent to the Division <br />separate from other correspondence. <br />As an alternative to temporary cessation, you may submit a <br />Technical Revision to your permit to indicate that the operation <br />will be intermittently active throughout its life. The technical <br />revision application must include a description of those <br />activities the operator will undertake to ensure compliance with <br />the permit reclamation requirements, and a description of the <br />site maintenance acts-vities which will ensure compliance with the <br />performance standard:. (Rule 3). Rule 1.13.7 addresses this <br />technical revision. <br />Since the annual report indicated that operations have <br />temporarily ceased, you should submit either a request for <br />temporary cessation or a technical revision within the next 45 <br />days. If the request. indicates that the site is sufficiently <br />stabilized, we will approve the request for cessation within <br />sixty days of receipt. If the request indicates that there may <br />be some problems witYl the site, we will either request more <br />information from you, or schedule the site for an inspection. If <br />you submit a technical revision to the permit, we will process it <br />within 30 days. <br />
