Natural Resource Conservation Service ~ MAY 0 5 2003 <br />2211 State Ave. Division ~f Minerals and De010rJy <br />Alantosa, CO 8J 107-3»9 <br />Rc: Battle Mountain Resources Inc. ~ 14~~~« a ~- <br />Monitoring Well M-4R <br />Dear Mr_ Metz: <br />Pursuant to our telephone conversation the other day, Battle Mountain Resources Inc_ (BMRI) understands <br />the Natural Resources Conversation Service (NRCS) intends to list the San Luis Project administrative and <br />maintenance shop facilities with a local Realtor. Further, the NRCS intends to adjudicate BMRI <br />monitoring well M-4R to a production well for water service supply to these facilities. As 1 indicated <br />BMRI has no objection to adjudicating monitoring well M-4R providing the Colomdo Division of Minerals <br />and Geology (CDMG) approves the proposed measure and written assurances by the NRCS and any future <br />owners of the property are given granting BMRI vehicular access to the monitoring well and ensuring well <br />access is maintained allowing BMRI to properly complete water sampling as long as the CDMG might <br />require. As requested, BMRI has secured and is transferring to the NRCS under separate cover, a copy of <br />the BMRI monitoring well M-4R drill wmpletion report for use in the adjudication process with the <br />Colorado State Engineer's Office. <br />On another note as I mentioned during our conversation, BMRI would greatly appreciate iC NRCS could <br />remote and clean-up materials leh b}' Delhur in the BMRI mine maunenance shop parking ditch and also <br />clean-up and remove an} mtcontained deleterious materials or hydrocarbon stained soils left by Delhur on <br />the NRCS propert}• before spring snowmelt or precipitation has an opportunity to wash these materials onto <br />BMRI property. <br />If BMRI can be of further assistance with the adjudication process or sale of the property, please do not <br />hesitate contacting me at either (719) 379-0798 or (303) 324-2630. <br />Sincerely, <br />i <br />ye <br />Director of Env.
