The State of Colorado has instituted legal proceedings <br />to recover additional bond money which proceedings are <br />now pending. <br />6. Corley desires to have Section 24 reclamation <br />completed, and MLRD desires to have additional time to <br />complete negotiations with Energy Fuels for reclamation <br />in Section 30 in a residual pit known as the East Pit. <br />Since Dr. Corley has been trying for years to get the Section 24 <br />land reclaimed he is naturally anxious about getting whatever <br />will be done, done. I believe that the following would work <br />reasonably well for both Dr. Corley and MLRD: <br />7. Corley Company will withdraw its termination of the <br />MLRD-Energy Fuels negotiation with regard to the East <br />Pit, and Corley will withdraw it denial of right of <br />entry to MLRD to Sections 19 and 30. Corley will allow <br />MLRD as much time as necessary to negotiate the East <br />Pit agreement. <br />8. MLRD will submit to Corley within 14 days of an <br />agreement a reclamation plan for Section 24 including a <br />committed amount of funding, but not less than <br />$125,000. <br />9. Corley will submit to MLRD its concerns, suggestions, <br />or objections, if any, to the MLRD Section 24 <br />reclamation plan within 7 days after receipt of MLRD's <br />suggested plan. <br />10. MLRD and Corley will cooperate to resolve any of <br />Corley's concerns, suggestions, or objections within 14 <br />days. (We will need some sort of mechanism for <br />resolving unresolved issues, if any. Could we submit <br />to an informal arbitration?) <br />11. MLRD will initiate the bid process for Section 24 <br />reclamation work as quickly as their regulations allow, <br />such that reclamation, including backfilling, <br />topsoiling, and seeding will be completed prior to May <br />1, 1992. <br />I certainly know and appreciate that the bureaucratic process <br />sometimes requires steps that slow down the working out of <br />agreements, but since much of this has already been in the works <br />
