r
Should you believe that some hazardous, noxious, or toxic material has been disposed of in
this area, we would recommend that you contact Kathy Hotovec at the Colorado
Department of Public Health and the Environment at (303) 692-3322. She can assist in
getting the appropriate personnel contacted to conduct an investigation.
As I mentioned to you in the field, the Division conducts approximately 10 on-site
inspections per year of this operation. We will continue to observe this area and should
conditions change, we may choose to conduct a more detailed analysis of the situation. Of
course, we would continue to keep the Soil Conservation District up-to date on any findings.
You may request in writing that the Administrator informally review the Division's decision.
Informal review under Rule 5.02.5(5) shall not affect your right to formal review under 34-
33-124 of the Colorado Surface Coal Mining Reclamation Act (Act) or to a citizen's suit
under 34-33-135 of the Act.
If you have questions, please call me.
Sinc~er~ely, //-/7
Kent A.
