Box 55 Oak Creek, Colorado 80467 Dear Mr. Canning: rala~ PItlDE1N~ ~~ ~ In Reply Rrfr, ru' 4411 CO-037 The Office of Surface Mining Reclamation and Enforcement (OSMRE) is in receipt of your letter dated August 11, 1988, concerning your estimated annual depletion of water from the Colorado River Basin. Our hydrologists have reviewed your calculations and agree with your results which indicate an average annual depletion rate of 3.36 acre feet. As explained in our July 13, 1988 letter to Sunland Mining Corporation, the above depletion rate has been used to calculate a dollar amount that will need to be paid to the U.S. Fish and Wildlife Service Conservation fund for offse+,ting the impacts of the Apex #2 mine to Federally listed endangered species. The current rate for calculation of the contribution is a one-time payment of $10/acre foot based on the annual estimated rate of depletion. Therefore, arrangements for payment of $33.60 (3.36 ac. ft. x $10.00) should be made as soon as possible. Payment should be made to: Regional Director U.S. Fish and Wildlife Service P.0. Box 25486 Denver Federal Center Denver, CO 80225 Please provide evidence of payment to this office. Once payment is made, OSMRE will proceed with the Federal permit termination process for Apex #2.
