Box 55 <br />Oak Creek, Colorado 80467 <br />Dear Mr. Canning: <br />rala~ <br />PItlDE1N~ <br />~~ ~ <br />In Reply Rrfr, ru' <br />4411 <br />CO-037 <br />The Office of Surface Mining Reclamation and Enforcement (OSMRE) is in receipt <br />of your letter dated August 11, 1988, concerning your estimated annual <br />depletion of water from the Colorado River Basin. Our hydrologists have <br />reviewed your calculations and agree with your results which indicate an <br />average annual depletion rate of 3.36 acre feet. <br />As explained in our July 13, 1988 letter to Sunland Mining Corporation, the <br />above depletion rate has been used to calculate a dollar amount that will need <br />to be paid to the U.S. Fish and Wildlife Service Conservation fund for <br />offse+,ting the impacts of the Apex #2 mine to Federally listed endangered <br />species. The current rate for calculation of the contribution is a one-time <br />payment of $10/acre foot based on the annual estimated rate of depletion. <br />Therefore, arrangements for payment of $33.60 (3.36 ac. ft. x $10.00) should be <br />made as soon as possible. Payment should be made to: <br />Regional Director <br />U.S. Fish and Wildlife Service <br />P.0. Box 25486 <br />Denver Federal Center <br />Denver, CO 80225 <br />Please provide evidence of payment to this office.
