The forms
you may need in order to amend and succeed to this operation aze attached.
To amend the present permit to a maximum of 9.9 acres, you must fill out the attached "Construction
Material Limited Impact (110) Operation Reclamation Perrnit Application Package," furnish new exhibits
showing your proposed changes in the mining and reclamation plans, and supply financial warranty
sufficient to cover the commercial cost of reclamation. The Amendment Fee is $719.00. As I indicated,
the reclamation bond for sites like these is generally in the range of $2,000 to $2,500 per acre, but maybe
more or less depending on local circumstances.
You will also need to submit the "Transfer of Approved Mineral Application" form and the "Succession
of Operator Application Package" with proper notarized signatures and application fee of $125.00.
It is important to know that in taking over the existing Reclamation Permit, you will assume responsibility
for reclamation that was incurred by the present permittee, even though it is on your own property. You
may not mine until the succession of operator application is approved, and you may not use reclamation
bond to reclaim the site.
Good luck with this transaction, and if you have any questions or need assistance, please feel free to
contact me at 303-866-3927.
Sincerely, ~v
TfQ
Hey
Senior Environmental Protecf Specialist
Cc: Stan Whinnery, Whim3ery Construction
Bob Oswald, Durango Field Office
Office of Office of Colorado
Mined Land Reclamation ARive and Inactive Mines Geological Survey
