Long
Division Director
On September 1, 1993, the Division received a letter from Mr. R.J. Ponce, Track Supervisor
with the Santa Fe Railroad (copy enclosed). In his letter, Mr. Ponce raises some concerns
with the Raton Creek Mine's Santa Fe loadouts (I believe Mr. Ponce incorrectly identifies the
permittee as Trinidad Basin Mining; t have attempted to call him to address this inconsistency,
but have been unable to reach himl. Mr. Ponce's concerns include possible impacts to the
railroad track and drain pipes, as well as with the roof bolts used as permit boundary markers.
Please contact Mr. Ponce as soon as possible to resolve his concerns with the impacts to the
track and drain pipes. With regard to the perimeter markers, we suggest that Energy Fuels
and Santa Fe Railroad discuss the possibility of using a different type of marker that would
remove any potential hazards to railroad workers and still comply with Rules 4.02.1, 4.02.3,
and 4.02.4.
Please call me for any assistance I can provide in helping Energy Fuels address Mr. Ponce's
concerns.
Sincerely,
7
Daniel I.
