The topic discussed was whether Basin Resources is required <br />to comply with Colorado Regulation 2.07.61211d) with regard to the Golden Eagle Mine. We <br />determined that we needed to investigate the date of existence of the Golden Eagle Mine (or the <br />Maxwell Mine, as it was previously namedl, as this regulation reads: <br />The proposed permit area is, subject to valid existing rights existing as of August 3, <br />1977, and with the further exception of those surface coal mining operations which <br />were in existence on August 3, 1977.. . <br />I reviewed the Colorado Division of Mines inspection report files for the Maxwell Mine. The <br />earliest report on file is one from an inspection that occurred on June 2, 1976. This report <br />contains the following information: <br />1 . An earlier inspection had occurred on April 15, 1 976. (A copy of the report from this <br />inspection wasn't on file in our offices.) <br />2. The "company" name was Coal Contractors, Inc. (Subsequent inspection reports dated <br />July 27, 1976, August 21 , 1 976, January 1 7, 1977, and March 21 , 1977 list the <br />"company" as CF&I Steel Corporation.) <br />3. Thirty-four people were employed at the site on that day (June 2, 19761. <br />4. The main incline was driven to a distance of approximately 80 feet by that day. <br />5. Explosives and ventilation equipment existed on site on that day. <br />6. Certificates far Mine Foreman, Assistant Mine Foreman, Fire Boss and Shot Firer existed on <br />that day. <br />Based on the information obtained from this inspection report, it would appear that the Maxwell <br />Mine was in existence before August 3, 1977.
