Summarv <br />The Review Process <br />The. Hayden Gulch Mine has applied for permit renewal number 3. <br />The original permit was issued on January 4, 1982, although coal <br />mining operations had started in January 1978. The first permit <br />renewal was issued on January 4, 1987, while the second permit <br />renewal was issued on January 4, 1992. The expiration date for <br />the second permit renewal was January 4, 1997. <br />On April 5, 1996 the Division sent a letter to the operator's <br />designated agent, TerraMatrix, in accordance with Rule <br />2.08.5(2)(a), informing the operator of the need to submit a <br />complete permit renewal package by July 8, 1996 or, possibly <br />losing the right of successive renewal. Although the operator <br />submitted permit renewal information, not all of the minimum <br />information was received in time. Therefore, on July 9, 1996 the <br />permit application was deemed incomplete by the Division. <br />All of the adequacy issues for Permit Renewal No. 3 were handled <br />in Technical Revision No. 63. Because the proof of publication of <br />the permit renewal application had not been submitted to the <br />Division until November 27, 1996, the permit renewal application <br />was not called complete by the Division until that date. On <br />December 30, 1996 the Division proposed to approve, without <br />stipulations, the Hayden Gulch Permit Renewal No. 3. <br />Because the current permit was due to expire on January 4, 1997, <br />and the new permit would not become effective until sometime <br />after that date, the question of the right of successive renewal <br />presented itself. In a letter dated November 27, 1996, the <br />Division granted the operator the right of successive renewal. <br />The Division's rational was that the right of successive renewal, <br />as defined in Rule 2.08.5(3)(f), can be granted if appropriate. <br />Since the Hayden Gulch Mine is fully reclaimed, with no surface <br />mining or reclamation activities taking place, the Hayden Gulch <br />Mine has a valid permit through this interim period. <br />Description of the Environment <br />The mine site is located in an upland area a few miles south of <br />Hayden in Routt County, at an elevation of approximately 7600 <br />feet. Land use in this area consists of grazing and wildlife <br />habitat. Several species of birds and large and small mammals <br />were noted in the area during a wildlife survey. Cattle are <br />grazed in the area from May until October, although the operator <br />has committed to no grazing on the mine site until final <br />reclamation. <br />The mine is situated within the Williams Fork Mountains which lie <br />at the southern edge of the Washakie Basin physiographic <br />3 <br />
