.;• <br />CBl-021: Holsin¢er A Co. 2 <br />(a) Up to sixty percent of the applicable bond amount shall be released <br />when the permittee successfully completes backfilling, regrading, and <br />drainage control in accordance with the approved reclamation plan; <br />(b) Up to eighty-five percent of the applicable bond amount shall be <br />released upon the establishment of vegetation which supports the <br />approved postmining land use and which meets the approved success <br />standard for cover, pursuant to 4.15.8, meets applicable productivity <br />standards for prime farmlands or alluvial valley floors pursuant to <br />3.03.1(3)(b), or croplands pursuant to 4.15.9. With the exception of <br />prime farmlands, evaluation of vegetation establishment pursuant to <br />this paragraph is based on statistically valid data collected during a <br />single year of the liability period; and <br />(c) The remaining portion of the bond amount shall be released when the <br />permittee has successfully completed all surface coal mining <br />reclamation operations in accordance with this approved reclamation <br />plan, and the final inspection and procedures of 3.03.2 have been <br />satisfied. This shall not be before the expiration of the period <br />specified for revegetation responsibility in 3.02.3. <br />The Bourg Mine property was backfilled and graded in 1988 with the permanent seed mix <br />planted in October 1988. The summer of 1999 will be the 10th growing season following <br />seeding. Year 1999 will be the earliest that the permittee would be eligible to request final <br />bond release on the reclaimed mine site. Walden Coal company applied for, and was <br />approved for bond release on the backfilling and grading portions of the reclamation on <br />December 4, 1989. The Northgate loadout north of Cowdrey, Colorado was approved for <br />final bond release on March 15, 1996. The loadout was approved for industrial post-mining <br />land use and not subject to the ten year liability period. <br />The reclaimed mine site has been approved for apost-mining land-use of rangeland and <br />wildlife habitat. The former facilities area at the mine were approved to remain to support <br />the post-mining land use in 1988. These permanent features consist of two cement pads, <br />a water well, a septic field, a gravel pad and the perimeter fence. A perimeter road remains <br />on the mine site to allow access to the property. <br />The Division's rules do not prohibit grazing on the reclaimed site prior to final bond release. <br />The Division's requirements for grazing are found in Rule 4.15.5: <br />4.15.5 Grazing. <br />(1) Domestic livestock grazing must not commence until one year after <br />seeding or planting and shall be managed to promote the postmining <br />land use. <br />
