Mining Plan Approval Document No. Co-0068 <br />Page 1 of 4 <br />UNITED STATES <br />DEPARTMENT OF THE INTERIOR <br />This mining plan approval document is issued by the United States <br />of America to: <br />Bear Coal Company, Inc. <br />P. 0. Box 518 <br />Somerset, Colorado 81434 <br />for the Bear No. 3 mine subject to the following conditions. <br />Bear Coal Company, Inc. is hereinafter referred to as the <br />lessee/operator. <br />1. Statutes and Regulations.--This mining plan approval is <br />issued pursuant to Federal coal leases D-052501 and C-42481; <br />the Mineral Leasing Act of 1920, as amended (30 U.S.C. 181 <br />et seq.); and in the case of acquired lands, the Mineral <br />Leasing Act for Acquired Lands of 1947, as amended (30 <br />U.S.C. 351 et seq.). This mining plan approval is subject <br />to all applicable regulations of the Secretary of the <br />Interior including, but not limited to, 30 CFR Chapter VII <br />and 43 CFR Group 3400, and to all regulations of the <br />Secretary of Energy, which are now or hereafter in force; <br />and all such.regulations are made a part hereof. The <br />lessee/operator shall comply with the provisions of the <br />Water Pollution Control Act (33 U.S.C. 1151 et seq.), the <br />Clean Air Act (42 U.S.C. 7401 et seq.) and other applicable <br />Federal laws. <br />2. This document approves the Bear No. 3 mine mining plan, <br />updated through April 13, 1989, and authorizes coal <br />development or mining operations on Federal leases D-052501 <br />and C-42481 within the area of mining plan approval. This <br />authorization is not valid beyond <br />T13S. R90W <br />Section 17: SE1/4, S1/2 NE1/4, NE1/4 NE1/4, S1/2 NW1/4, <br />E1/2 SW1/4, and portions of the W1/2 SW1/4 <br />Section 20: portions of N1/2 N1/2 <br />as shown on the map appended hereto as Attachment A. <br />The lessee/operator shall conduct coal development and <br />mining operations only as described in the complete permit <br />application package, updated to April 13, 1989, and approved <br />by the Colorado Mined Land Reclamation Division, except as <br />
