-; <br /> <br />Per Rule 6.5, a Geotechnical Stability Exhibit demonstrating the appropriateness of these setbacks <br />is included with this permit application, but per comments of the DMG written agreements with <br />PSCo. and Sinclair Pipeline, or a revised Stability Analysis acceptable to the DMG proposing <br />lesser setbacks, will determine setbacks from the PSCo. towers and the Sinclair Pipeline. Item <br />#7 - Sorenson's comments <br />The only present uses on the property are range land for cattle on the portions of the property west <br />of the S. Platte River, and an area of the plant site presently used for mobile home storage. No <br />structures exist on any of the property except for fencing and isolated farm structures on the portions <br />ofthe property west ofthe River. There are extensive tree stands along the River and on portions of <br />Pazcel A. A Division of Wildlife (DOW) questionnaire was completed, and no endangered or critical <br />wildlife habitat was identified. Surveys for the Ute Ladies tresses orchid and the Prebles meadow <br />jumping mouse were also conducted, and neither were found to be present. It is expected that <br />jurisdictional wetlands on portions of Parcel B, Pazcel C, and perhaps Parcel A will be identified, and <br />a permit from the Army Corp of Engineers to create replacement wetlands will be necessary to <br />remove all or portions of any identified wetland areas. A wetland delineation is being prepared by <br />another consultant, who will also process the necessary permit to remove any existing wetlands and <br />provide for wetland's replacement, and prior to excavation of any jurisdictional wetlands <br />requiring a 404 permit for excavation and filling, the appropriate 404 permit will be obtained <br />from the Corp of Engineers. Item #12 and 25 <br />All of the property east and most of the property west of the S. Platte River are within the 100 year <br />floodplain of the River. No mining shall occur within 400' of the low flow channel of the S. Platte <br />River without approval of the Urban Drainage and Flood Control District (UD&FCD), and all <br />activities within the 100 year floodplain of the S. Platte River shall require a Flood Plain Use Permit <br />from Adams County. Any stockpiles of topsoil and overburden in the floodplain, and particularly in <br />the floodway area, will be placed in accordance with approvals of the UD&FCD and the Floodplain <br />Use Permit. General proposed standards for the placement of stockpiles in any floodplain area have <br />been included in Exhibit G. A conveyor will also be constructed across the S. Platte River from the <br />west portion of the property (D parcels) to the plant site (C parcels), and UD&FCD approval and a <br />Floodplain Use permit from Adams County for the conveyor's support structures in the S. Platte <br />River floodplain area will also be obtained. <br />The site contains approximately 1+ feet of topsoil and overburden overlying 30± feet of alluvium <br />sand and gravel material underlain by clay shale and/or claystone bedrock, which acts as a natural <br />barrier between the alluvium aquifer and the deeper bedrock aquifers. A slurry wall will be installed <br />around the perimeter of the D parcels to limit groundwater infiltration for dry mining and a future <br />sealed storage water facility for reclamation. <br />2 <br />
