'`t1 `"'.; <br />Denver, CO 80202 <br />RE: Lease Audit No. 709058; Oliver, Colorado <br />Dear Mr. Hardin: <br />~u1Hf`2 <br />ants <br />9Cit~ <br />Please refer to your lease of Railroad property for Lessee-owned coal silos, coal storage <br />and related actives at or near Oliver, Colorado, under the above referenced Lease Audit Number. <br />I have recently been contacted by Ms. Ericia Crosby of the Division of Minerals and <br />Geology, Department of Natural Resources for the State of Colorado, regarding the Divisions' <br />interest in demolishing the two silos located on the subject property in conjunction with the <br />remaining reclamation work at the former Hawks Nest Mine. I have enclosed a copy of Ms. <br />Crosby's latest correspondence, dated June 2, 1993, which discusses this matter in further detail. <br />There are several issues that need to be resolved before this demolition work can <br />commence; one of which is having the Railroad pure the appropriate fjight_of_Entry <br />Agreement for the remaining property not under lease at this site, as well as protection of our <br />tracks and the corresponding car movement in the area. By copy o r I am forwarding <br />Ms. Crosby's letter to Mr. Jerry Pearson in our Engineering/Contract Department for his further <br />handling on this matter. Please note, the Railroad intends to prepare a Right of Entry Agreement <br />for the State of Colorado for the area that is currently not under lease, however, I presume that <br />the demolition process will also include the State of Colorado and their assigned contractor <br />entering the lease premises to complete this work.
