Long <br />Houston, Texas 77074 0~~~:~o~o~re<ior <br />RE: Response to letters dated May 4, 1995, May 11, 1995, <br />May 18, 1995, and May 24, 1995 concerning Golden Eagle Mine, <br />Basin Resources, Inc., Permit ~`C-81-013 <br />Dear Ms. Tatum: <br />Both the May 4, 1995 and May 11, 1995 letters reference Mr. Carl <br />Gerity's interest in obtaining copies of the report from the study <br />conducted at the Allen Mine (now known as New Elk mine) <br />approximately ten years ago. Apparently there was some confusion <br />on our part about who had conducted the study. Based on my <br />telephone conversations with you on May 10, 1995 and Mr. Gerity on <br />May 9, 1995, we all agree, at this point, that the study being <br />refereed to is the Woodward-Clyde study which Mr. Gerity has <br />located. I apologize for the confusion and assure you that our <br />mention of the study was not meant to confuse but rather to <br />indicate that additional information might be available. <br />Your letter of May 4, 1995 states "I note that neither Pendleton or <br />Rosenthal can come up with any other reason for the movement in my <br />home, however, they both admit the home has moved." While it is <br />true that we have observed evidence of movement of the upper walls <br />in an outward motion, absolutely no evidence of movement of the <br />foundation of the home has been observed by any parties. Movement <br />of the foundation is the critical indicator of mine subsidence. <br />Without evidence of movement of the foundation we can make no <br />finding except that mine subsidence has not impacted the home. <br />Further we continue to believe that no subsidence related to the <br />1st north mains has occurred. In addition, our charge in this <br />investigation was only to determine if subsidence had occurred, and <br />if it had occurred, was subsidence impacting your home. Therefore <br />it is not appropriate for us to speculate or advise you of other <br />reasons for damage occurring to your home. <br />As I indicated to you during our telephone conversation of May 10, <br />1995, Mr. Steve Lautenschlager, Assistant State Engineer, is the <br />person in the State Engineer's Office who has been assisting us in <br />our investigation of the windmill well. <br />
