The pit area is <br />less than 2 acres (1.99) and the material mined is not used for construction <br />purposes---alabaster is too soft and weathers too easily to be used in <br />construction, and the Operator (Stanley Jones) is supplying most of his <br />material to sculpture and art schools. Therefore, it continues to qualify <br />under C.R.S. 34-32.5-110(7)(a) as a 110(1) permit, paying only $75 in fees <br />per year.
