<br />The applicant has committed to monitoring field parameters on larger seeos <br />quarterly and on a monthly basis during spring runoff. Fuii sui;:e anaiysas <br />will be taken from three springs on a biannual basis. An annual <br />reconnaissance to identify the location, flow and field parameters of all <br />springs will occur every May. <br />The proposed surface water monitoring plan lists sites on both Foidel and Fish <br />Creeks. Site 14, on the north fork of Foidel currently is an upstream site <br />which reflects undisturbed conditions of an intermittent drainage, and will be <br />monitored monthly during flow. U.S.G. S. 09243800 will monitor impacts from <br />Eckman Park and the proposed Little Middle Creek tract; site 8/2005 will <br />monitor influences from the adjacent Foidel Creek Mine and i4ine 1; USGS site <br />09243900 is furthest downstream and will show the effects of dilution from <br />runoff on Foidel Creek. The latter three sites will have field parameters <br />recorded twelve times per year and full suite analyses in April, June, August <br />and September. The Fish Creek site, upstream of t4ine 2 (Site 16) and the <br />station downstream of Mine 2 (Site 26/1002) will have a similar monitoring <br />frequency. <br />The Division finds the operation in compliance with the requirements of this <br />section. <br />VII. W;i`:=r ^ights and Replacement - Rules 2.04.7, 2.05,5(3)(a)(ii <br />c <br />Water rights information can be found in Table 2 and Section 779-77 of the <br />Eckman Park Renewal application and Section 779-17 (Volume 1) and 816,54 <br />(Volume 2) of the C-81-071 permit document, <br />Ground water rights within Twentymile Park are found in the Trout Creek <br />sandstone aquifer, the Trout Creek alluvium, the upper Williams Fork sandstone <br />aquifer and the Middle Creek alluvium. The uti]ization of ground water from <br />the Trout Creek sandstone was not classified in a great detail. It is <br />predominately employed for domestic, industrial and irrigation purposes. The <br />other aquifers' water is used domestically (Table 1). <br />Table 2 documents the ownership of ground water rights in Twentymile Park <br />Cypress 'destern Coal Company (CWCC) controls most of the bedrock aquifers, <br />while individuals own all the wells in the alluvial aquifers. Nevertheless, <br />CWCC controls 88% of the adjudicated ground water in the basin. <br />15 <br />
