Introduction <br />This document is the decision package prepared by the Colorado Mined Land <br />Reclamation Division (the Division) for the Colowyo Mine. This document updates <br />the findings documents prepared in 1982, 1987 and 1989, and includes: 1) the <br />proposed decision to approve the application for a permit revision and renewal; <br />2) a summary which includes: a history of the review of the permit application, <br />a description of the environment affected by the operation and a description of <br />the mining and reclamation plan; and 3) the written findings of compliance the <br />Division has made as required by the Colorado Surface Coal Mining Reclamation <br />Act. Detailed information concerning the findings of compliance can be found in <br />the Regulations of the Colorado Mined Land Reclamation Board for Coal Mining. <br />The Division has received an application for a permit revision (PR-O1) and <br />renewal of a permit to conduct surface coal mining and reclamation operations at <br />the Colowyo Mine. The application was submitted by Colowyo Coal Company and the <br />mine will be operated by Colowyo Coal Company. The mine is located on federal, <br />state and private lands within Moffat and Rio Blanco Counties, Colorado. The <br />legal description of the lands included within the permit area is: <br />Township 4 North, Range 93 West, portions of <br />Sections 15, 22, 23, 26, 27, 28, 33, 34; Township 3 <br />North, Range 93 West, portions of Sections 2, 3, 4, 8, <br />9, 10, I1, 14, 15, 16, 17, 20, 21, 22; <br />west of the 6th P.M. <br />y more precise legal description can be found on page 2.03-15 cf *_'_:c rcrnit <br />application. The mine site can be located on the following U.S. Ge~l~gical <br />Survelr 7.5 minute :naps: Axial, Colorado, and Ninemile Gap, Cclorac. <br />Proposed Decision <br />The Colorado Mined Land Reclamation Division proposes to approve an application <br />for a perr„it revision and permit renewal which entails adding 1,878 acres to the <br />permit area along with adding two additional open pits (Section 16 and West <br />Pits) . <br />The application was submitted by Colowyo Coal Company for the Colowyo Mine. This <br />decision is based on a finding that the operations will co«~ly wit; all <br />requirements of the Colorado State Program as found in the Colorado Surface Coai <br />Mining Reclamation Act, C.R.S. 34-33-101 et seq., and the Regulations promulgated <br />pursuant to the Act. If no request for a formal hearing is made within thirty <br />(30) days of the first publication of the issuance of this proposed decisior_. <br />then this decision becomes final upon submittal of acceptable surety by the <br />applicant.
