BANTA, Director <br />July 18, 1988 <br />Mr. & Mrs. Robert Kuretich <br />1846 4365 Lane <br />Paonia, Colorado 81428 <br />RE: Terror Creek Loadout Permit Renewal, C-83-059 <br />Dear Mr. 8 Mrs. Kuretich: <br />As part of the renewal process for the Mining Permit and subsequent to a <br />revision request made by Terror Creek Company the Air Emission Permit for the <br />Terror Creek Loadout was evaluated by the Colorado Department of Health. This <br />revision request and evaluation resulted in modification and clarification of <br />the Emissions Permit. <br />In addition, Terror Creek Company conducted a planned application of a <br />chemical dust suppressant in the yard area in May, 7988: All other dust <br />control measures which are required of Terror Creek Company have been <br />implemented: <br />The Division, therefore; believes that the Terror Creek Loadout is in <br />compliance with their Mining Permit and their Air Emissions Permit. <br />If you continue to have concerns which you would like to raise before the <br />Division makes a proposed decision on the renewal of this Mining Permit you <br />may request an informal conference. After a proposed decision is made by the <br />Division you mdy request a formal hearing before the Mined Land Reclamation <br />Board if you object to the proposed decision. Objections must be focused on <br />the criteria listed in Rule 2.08.5(3). I have enclosed copies of Rule <br />2.07.3(6) concerning informal conferences and Rule 2.08.5(3) concerning <br />criteria for approval or denial of a permit renewal: <br />If you have arty questions please feel free to call. <br />Since rely; <br />~~ . ~~, <br />Susan J.
