Reclamation Act or the Colorado Surface Coal Mining Reclamation Act <br />(2.07.6(2)(g)(i)). <br />8. Twin Pines Limited Investment Partnership does not control and has not controlled <br />mining operations with a demonstrated pattern of willful violations of the Act of such <br />nature, duration, and with such resulting irreparable damage to the environment as to <br />indicate an intent not to comply with the provisions of the Act (2.07.6(2)(h)). <br />9. The Division fmds that surface coal mining and reclamation operations to be performed <br />under this permit will not be inconsistent with other such operations anticipated to be <br />performed in areas adjacent to the permit area (2.07.6(2)(1)). <br />10. The Division currently holds two certificates of deposit for the Twin Pines No. 2 Mine. <br />The CD amounts are $54,130.00 and $984.00. The bond amount for the Twin Pines <br />No. 2 Mine and Sales Area is currently under review pursuant to the procedures of <br />3.02.2(4). If the Division calculates a bond liability which is higher than the amount <br />currently held, notification will be provided also pursuant to the procedures of <br />3.02.2(4) (2.07.6.(2)(j)). <br />11. The Division has made a negative determination for the presence of prime farmland <br />within the permit area. The decision was based on a letter from the Soil Conservation <br />Service dated January 27, 1983, which states that no prime farmland is found in <br />Section 2. The letter can be found on page 64e of the permit application <br />(2.07.6(2)(k)). <br />12. Based on information provided in the application, the Division has determined that an <br />alluvial valley floor exists within the area adjacent to the permit area. The alluvial <br />valley floor (AVF) is known as Oak Creek and was potentially affected by mining <br />operations (2.07.6(2) and 2.06.8(3)(C)). Information on the Oak Creek AVF can be <br />found in permit Section 2.06.8, page 97 and JFSA-70 through 80. Studies have shown <br />that the impact to Oak Creek has not been significant. No construction of surface <br />facilities or undermining occurred within this AVF. According to the original Findings <br />Document, the potential impact to Oak Creek AVF would be degraded water flowing <br />into the creek. The mine was designed to prevent this from occurring. In the history <br />of the mine's operation, this has not occurred. Since the mine is in the initial stages of <br />reclamation and has ceased mining, the potential threat to water quality is negligible. <br />For additional specific fmdings concerning this alluvial valley floor, please see <br />Section B, XVII of this Findings Document. <br />13. The Division hereby approves the post-mining land use of the operation. It was <br />determined that grazing/rangeland meets the requirements of Rule 4.16 for the permit <br />area (2.07.6(2)(1)). <br />14. Specific approvals have been granted or are proposed. These approvals are addressed <br />in [he following section, Section B (2.07.6(2)(m)). <br />19 <br />
