Box 758 <br />Greeley, Colorado 80631 <br />RE: Hokestra Pit Status <br />Our File 1180-14~ <br />Dear Mr. Smyth: <br />III IIIIIIIIIIIII III <br />999 <br />On June 9, 1980, the Mined Land Reclamation Board found Weld County in violation <br />of mining without a permit and operating against a cease and desist order. The <br />Board also directed the Attorney General to initiate injunction proceedings <br />against Weld County to stop all mining operations in the above pit. The Board <br />also set a hearing to consider possible civil penalties, for said violations, at <br />the July 23-24,1980 Board meeting. <br />Circumstance forstalled the injunction proceedings. At the July 23, 1980 Board <br />meeting the Board found a maximum penalty of (2) two days of operating without a <br />permit which occurred in the spring of 1980, or a total of $2000.00 civil penalty. <br />The Board suspended $1000.00 of the penalty, pending approval of the permit appli- <br />cation. <br />On November 12, 1980, the Mined Land Reclamation Board approved the above appli- <br />cation. The $1000.00 suspended penalty was therefore finalized by the permit <br />approval. However, the remaining $1000.00 of the original $2000.00 civil penalty <br />must be paid,. per the July 23, 1980 Board ruling. Please submit the $1000.00 <br />'payment as soon as possible. If such payment will not be forthcoming by the end <br />of February 1981, please notify the Division as to when such payment will be made. <br />The above application proved to be a difficult situation for all parties concerned. <br />The ultimate out come, however, provided for a good reclamation plan for the site, <br />adequate protection to off-site properties, and a renewed spirit of cooperation <br />between the two units of government. The division looks forward to working with <br />Weld County under more favorable conditions in the future. <br />The mining and reclamation permit for the above application is attached.
