This is the Technical Revision which addressed the NW-1 <br />exhaust shaft. <br />Several months ago when you telephoned me I do not remember <br />discussing TR-15 with you. Rather, I recall that I directed you to <br />Joe Dudash, as he was the Reclamation Specialist assigned the <br />Golden Eagle mine at that time. <br />I was the Reclamation Specialist who reviewed and approved TR-15 on <br />November 28, 1990. The language regarding noise reduction <br />structures is a part of TR-15. This language was not required by <br />me, however, since the Division has no statutory or regulatory <br />basis for such a requirement. I was aware that the exhaust shaft <br />installation may generate noise and that there may be noise impacts <br />to workers nearby. I therefore requested that the permittee <br />include a provision for noise reduction structures. They agreed to <br />this request and included the language. Inclusion of the language <br />on the part of the permittee was discretionary, however, not <br />compulsory. <br />On August 9, 1990 I approved TR-14 which addressed the intake shaft <br />installation. As you are aware, TR-14 does not include any <br />language regarding noise reduction structures. You asked why I did <br />not request noise reduction structures language in this earlier TR. <br />I was not aware that noise levels associated with the intake shaft <br />installation could potentially pose a problem. Moreover, as stated <br />above, because the Division has no jurisdiction over noise levels, <br />noise levels were not, and are not, under my purview. <br />
