In general the surveyor was to survey
fifty feet beyond the original edge of the ridge down the surrounding slopes. When the mining
was actually performed, however, the survey had not been staked, the survey stakes were not
visiUle, or the daylighting could not be performed in accordance with the surveyed lines. The
consequence is that a total of less than .32 acres have been disturbed outside of the permitted
boundaries. No additional disturbance will occur in these areas and in fact a portion of the
disturbed area outside of the boundaries has already been reclaimed (area C and part of area B on
the map). The photographs which I am sending have been numbered on the back and keyed to
the,map to show the terrain in which we are working. It is easy to recognize why it is difficult to
be r:xact in this type of area.
Because the disturbed property outside of the boundary is so minimal, because the mining
in t'slese areas has all occurred in the past, because no further disturbance is anticipated and
because it would not appear to be economically feasible to seek to amend the permit in this area at
the present time, it is hoped the matter can be resolved in some way without a finding of violation
or the imposition of the penalty. As a practical matter, the County is looking at the possibility of
squaring up the boundaries in the Antelope Hill gravel operation in the future. (See additional
map attached). If this is accomplished, all of the disturbed area will be within the permit.
COUNTY 7/antelope.doc
