This document contains the findings and decision pertaining to a Request for Transfer of <br />Coal Permit and Succession of Operators (succession). The succession application was <br />received by the Division of Minerals and Geology (DMG) on January 2, 2002. The <br />succession application proposes a transfer of DMG Permit No. C-1981-041 from the <br />current permittee and operator, which is Powderhom Coal Company, to a new.permitee <br />and operator, which is Snowcap Coal Company, Inc. The application was submitted and <br />reviewed pursuant to the procedures of Rule 2.08.6 of the Regulations of the Colorado <br />Mined Land Reclamation Board for Coal Mining. The DMG hereby approves the <br />succession request. <br />Process <br />On January 2, 2002, the above-referenced succession application was received at the <br />offices of the DMG. This initial application included a properly executed Request for <br />Transfer of Coal Permit and Succession of Operators form, as required by Rule <br />2.08.6(2)(6), along with application materials addressing legal, financial, and compliance <br />requirements pursuant to Rule 2.03. The application was deemed administratively <br />complete on January 7, 2002. DMG sent an initial adequacy letter to Snowcap Coal <br />Company, Inc. (Snowcap) on that date, and advised Snowcap to proceed with publication <br />of the public notice. The newspaper notice required by Rule 2.08.6(3) was published in <br />the Grand Junction Daily Sentinel on January 13, 2002. The Affidavit of Publication was <br />received by DMG on Januazy 23, 2002. The Division received amended application <br />materials in response to the initial adequacy ]etter, on January 24, 2002. DMG requested <br />additional Identification of Interests information by letter of February 5, 2002, and the <br />information was received on February 22, 2002. Information and documentation <br />regazding right of entry was which had been requested by the Division was provided in <br />various submittals during February and Mazch 2002. A properly executed and adequate <br />reclamation bond was accepted on February 8, 2002. The proposed decision to approve <br />the succession application was-issued-March 15, 20D2. <br />Findings <br />1. The DMG hereby finds that a properly executed Request for Transfer of Coal <br />Permit and Succession of Operators application form has been submitted to the <br />DMG, and this form requests that the DMG Permit No. C-1981-041 be transferred <br />from Powderhom Coal Company to Snowcap Coal Company, Inc. (2.08.6(2)(6)). <br />2. The DMG hereby finds that a properly executed Surface Coal Mining and <br />Reclamation Operations Reclamation Bond, in the form of Corporate Surety No. <br />014-018-026, for the amount of $3,264,149.00 (three million, two hundred sixty- <br />four thousand and one hundred forty-nine dollars), has been submitted by <br />Snowcap Coal Company, Inc. for Permit No. C-1981-041, and the bond has been <br />accepted by DMG (2.08.6(2)(a) and 2.08.4(4)(6)). <br />
