DBMS staff opinion is that contamination generated from stockpiles at the SM-18 site will migrate <br />very slowly if at all and only very short distances from stockpiles, (assuming normal precipitation), and <br />will be naturally attenuated in the soil and bedrock, amounting to a minima] threat of environmental <br />contamination. Thus, under Rule 7.2.6 (1), Cotter has demonstrated to the Division that no toxic or acid <br />forming materials will be disturbed in quantities sufficient to adversely affect the human health, property <br />or the environment. Therefore, the Boazd should exempt the SM-18 Mine from the requirements of <br />Rule 7, which Rule implements Section 34-32-116.5, C.R.S. 1984 as amended. <br />G.
