A recent <br />review of the ApplicanWiolator System (AVS) System has shown that a "Deny' recommendation exists for <br />the renewal of CDMG Permit No. C-69-074. This "Deny" recommendation exists due to the administrative <br />link between Rimrock Coal Company and Richard Randall of Randall and Blake, Inc of Colorado. Mr. <br />Randall is currently listed in the AVS as having had an interest in Randall and Blake, Inc. of Oklahoma at a <br />time when Randall and Blake, Inc. of Oklahoma was associated with certain Oklahoma operations that had <br />received enforcement actions from the State of Oklahoma. Civil penalties issued to these Oklahoma <br />operations currently total $90,000.00. <br />It has come to our attention that Randall and Blake, Inc. of Colorado requested, and was recently granted, <br />a second postponement of an Informal Conference scheduled with the State of Oklahoma regarding <br />Randall and Blake, Inc. of Colorado's interest in these matters. The new Informal Conference is now <br />scheduled for December 8, 1995. <br />We sincerely hope that the December 8, 1995 Oklahoma Informal Conference results in the State of <br />Oklahoma revising its AVS "deny" recommendation. Please understand that if the AVS recommendation <br />on the December 12, 1995 renewal decision due date is "Deny", the Division will have no choice but to <br />issue a proposed decision to deny renewal of the CDMG Permit No. C-89-074 for the Rimrock Strip Mine. <br />The ApplicanWiolator System (AVS) is a nationwide computerized data system developed by the <br />U.S. Office of Surface Mining (OSM) which contains information pertaining to ownership, control, and <br />enforcement of coal mining and reclamation operations in the United States. Under a March 12, 1991 <br />Memorandum of Understanding (MOU) between the State of Colorado and OSM, the Division periodically <br />reviews the information in this data system to determine whether any operations in Colorado are <br />associated administratively with operations in other states that have any unresolved enforcement actions <br />pending, any fees or penalties outstanding, or have had any mining permits revoked and/or bonds <br />forfeited. <br />Please contact me at (303) 866-3567 regarding this matter. <br />Sincerely, <br />Daniel I.
