Box 1821
Colorado Springs, CO 80901
RE: January 18, 1993 Citizen's Request for Inspection
Dear Dr. Corley:
OF'~n[p\
~~ ~b~
J~o
•~;~ µv'.u~./'
~ X8]6
Roy Romer
Wvernor
ALChael B. Long
Uiv isian Director
On January 19, 1993 the Division received The Corley Company's
January 18, 1993 request for an inspection of a portion of Corley
Company property. The request raised a concern with possible surface
disturbances to Corley Company property being created by erosion from
an area known as the Hastings Strip. The Division has completed its
investigation, and provides the following response.
Inspections conducted under Rule 5 of the Regulations of the Colorado
Mined Land Reclamation Board for Coal Mining (rev. 6/30/91) pertain to
operations regulated under the Colorado Surface Coal Mining Reclamation
Act (34-33-101 et seq., C.R.S. 1973 as amended) and the Regulations.
This would include mines which are actively mining, as well as those in
their 10-year period of reclamation. Sites which have had their
permits revoked and bonds forfeited are no longer subject to the normal
enforcement process. This is the case at the revoked Hastings Strip.
The Hastings Strip Mine (CMLRD Permit No. C-77-035) has had its permit
revoked and bond forfeited. This site was reclaimed by the Inactive
Mines Program of our Division in 1986 using the forfeited bond monies.
Our files indicate that $682.00 has been retained by the Division for
erosion maintenance and/or revegetation uses. In discussing your
concern with David L. Bucknam, Supervisor of the Inactive Mines
Program, it was determined that the Division will address the situation
at the site as far as the remaining $682.00 allows. This remaining
work at the Hastings Strip Mine will be performed in conjunction with
the GEC Strip Mine reclamation project to be conducted later this year.
Should you have any further questions regarding the status of these
projects, please contact Mr. Bucknam at (303) 866-3567.
