I have received your letter dated February 24, 1981, in which you inquire <br />about the propriety of extracting gravel from the above captioned Montrose <br />County gravel pit for use in a Colorado Highway Department project. It is II{y <br />opinion that this use of gravel from your pit is not precluded by the <br />requirements of the Minerals Rules and Regulations. <br />It should be remembered, however, that the permittee, Montrose County, +s <br />ultimately responsible for adherence to the approved mining and reclamation <br />plans by any operator allowed into the permit area. Furthermore, this 'is a <br />limited impact, 110 operation and, as such, a maximum of only 70,000 tons of <br />overburden plus product may be excavated per calendar year. The 50,000 tons <br />required for this project (plus any associated overburden removed) must count <br />toward this total for 1987. <br />Thank you for your letter.
