<br /> <br />Attachment A of Federal Permit CO-0069 Termination, December 1988 <br />Conditions of Mining Plan Approval <br />Page 1 of 4 <br />CONDITIONS <br />OF <br />MINING PLAN APPROVAL <br />This document contains the applicable conditions of approval of the Munger <br />Canyon mine mining plan approved on December 22, 1982, for Federal coal <br />leases C-0125515 and C-0125516. Salt Creek Mining Company is hereinafter <br />referred to as the lessee/operator. <br />Condition 1. Statutes and Regulations.--The mining plan approval was made <br />pursuant to Federal coal leases C-0125515 and C-0125516; the <br />Mineral Leasing Act of 1920, as amended (30 U.S.C. 181 et <br />she .); and in the case of acquired lands, the Hineral Leasing <br />Act for Acquired Lands of 1947, as amended (30 U.S.C. 351 et <br />sec.). The mining play approval is subject to all applicable <br />regulations of the Secretary of the Interior including, but <br />not limited to, 30 CFR Chapter VII and 43 CFR Group 3400, and <br />to all regulations of the Secretary of Energy, which are now <br />or hereafter is force; and all such regulations are made a <br />part hereof. The lessee/operator shall comply with the <br />provisions of the Water Pollution Control Act (33 U.S.C. 1151 <br />et seg.), the Clean Air Act (42 U.S.C. 7401 et seg.) and <br />other applicable Federal laws. <br />Condition 2. The current mining plan approved on December 22, 1982, covers <br />all or portions of Federal coal leases C-0125515 and <br />C-0125516 as described below: <br />T. 7 S.. R. 102 W. <br />Portions of Sections 27, 28, 33, and 34 <br />T. 8 S.. R. 102 W. <br />Portions of Sections 2, 3, and 4 <br />as shown on the map appended hereto as Exhibit A. <br />Condition 3. The lessee/operator shail conduct coal development and mining <br />operations only as described is the complete permit <br />application package approved by the Colorado Mined Land <br />Reclamation Division, except as otherwise directed in the <br />conditions of the mining plan approval as contained herein. <br />
