Recommendation <br />I recommend termination of Federal permit CO-0069, issued on December <br />22, 1982, for Salt Creek Mining Company's Munger Canyon mine. My <br />recommendation is based on the esiatence of the Colorado cooperative <br />agreement which provides for the delegation to the Colorado Mined Land <br />Reclamation Division (NERD) of the permitting responsibilities for <br />operations on Federal lands pursuant to Section 523 of the Surface <br />Mining Control and Reclamation Act (SMCRA); the issuance of the <br />Colorado State permit C-81-020 in accordance xith the Colorado State <br />program snd cooperative agreement; incorporation of all necessary <br />Federal permit conditions in the State permit; snd the approved mining <br />plan for Federal leases C-0125515 and C-0125516. Attached to this <br />memorandum are the applicable standard conditions of approval of the <br />Munger Canyon mine mining plan approved by the Assistant Secretary on <br />December 22, 1982, for Federal leases C-0125515 and C-0125516. These <br />conditions rare previously incorporated in the Federal permit. <br />Notxithetanding the termination of the Federal permit, these <br />conditions will remaln in full force and effect. <br />Colorado MLRD hoe reviewed the permit application package (PAP) for <br />the Munger Canyon mine under the Colorado State program sad <br />cooperative agreement (30 CFR 906.30) and has issued Colorado permit <br />C-81-020 authorizing surface coal mining and reclamation operations on <br />Federal and non-Federal lands is the permit area pursuant to the State <br />program and cooperative agreement. A copy of the bond in the amount <br />of $322,700, payable to the United States sad the State of Colorado, <br />is on file with OSMRE. <br />
