• Pursuant to the Colorado State program and the cooperative <br />agreement, DMG approved the permit revision on August 18, <br />1997 . <br />The Office of Surface Mining Reclamation and Enforcement <br />(OSM) has consulted with other Federal agencies for <br />compliance with the requirements of applicable Federal laws. <br />Their comments and/or concurrences are included in the <br />decision document. <br />The Bureau of Land Management (BLM) reviewed the resource <br />recovery and protection plan for compliance with the Mineral <br />Leasing Act of 1920, as amended, and 43 CFR Part 3480. The <br />BLM recommended approval of the mining plan modification in <br />a memorandum dated August 18, 1997. <br />OSM's independent review dated September 23, 1997 of the <br />effects of the proposed actions on threatened and endangered <br />species indicates that no adverse effects will occur to any <br />threatened or endangered species as a result of the proposed <br />actions. OSM expects that consultation with the U.S. Fish <br />and Wildlife Service under Section 7 of the Endangered <br />Species Act will confirm this evaluation prior to any mining <br />plan decision. <br />• The State Historic Preservation Officer (SHPO) concurred <br />with the proposed mining plan actions in a letter dated <br />September 10, 1997. <br />The proposed areas of mining plan approval are not <br />unsuitable for mining according to section 522 (b) of SMCRA. <br />The mining plan modification areas are not on any Federal <br />lands within the boundaries of any national forest. <br />I have determined that approval of these mining plan <br />modifications will not have a significant impact on the <br />quality of the human environment. The environmental <br />analysis prepared by BLM and OSM for the Coal Lease <br />Modification Application For Leases C-29125 and COC-49465, <br />EA Number CO-038-96-30 and other environmental documents <br />noted in the Finding of No Significant Impact (FONSI), <br />describe the impacts that may result from approval of these <br />mining plan actions and their alternatives. The FONSI and <br />supporting environmental analyses are included in this <br />decision document. <br />OSM's review of the proposed action identified no issues <br />that required resolution. <br />• Publication of four consecutive weekly newspaper notices in <br />the Durango Herald notified the public of the availability <br />3 <br />
