_P8_ The proposed design for the East dump calls for subtle, less than 5:1 (horizontal to vertical) slopes. "The general land form of the East dump will be that of a rounded mound some 200 yards northeast of where a natural rounded mound stood before mining" (Page 11, Appendix J). Rule 4.14.2 specifically requires that all areas affected by surface mining operations shall be returned to their approximate original contour. The applicant proposes to restore the mine site to approximate original contour. The Division has evaluated the relocation of a minor ridge by 200 yards and has determined that the resulting postanining topography meets the requirements of approximate original contour. The operation is in compliance with the requirements of this section. XVIII. Mine Facilities, Coal Handlin Structures u es an port Facilities - The mine facilities, coal handling structures, and support facilities sections of the application have been reviewed by the Division for compliance. This information can be found in section D of the permit application. All structures and facilities have been designed in accordance with the applicable performance standards. The operation is in compliance with the requirements of this section. XIX. Coal Processin Waste and Non-Coal Processing Waste - Rules £.~T~.3T9T-~3Tf~~0~3TT6~~(15~721T1'~: aTD~~II The Division has reviewed the application for compliance with these sections. Information is contained on page D-3a of the application. This operation will not produce any coal processing waste. All non-coal waste will be appropriately disposed of. The operation is in compliance with the requirements of this section. XX. Roads - Rules 2.05.3 (3)(c)(i) and 4.03 The Division has reviewed the relevant sections of the permit application (Section D, pages 6-g) for compliance. The haul road at the mine is in two sections. fie first section is an upgraded BLM right-of-wdy 4732 feet long; the second is 2768 feet of new road. The information contained in the application verifies that the location, design, construction, drainage, surfacing, maintenance, and reclamation of the roads were planned with the consideration of the design and performance standards of Rule 4.03.1. It should be noted that Rule 4.03.1(4) contains specific designs for the spacing of culverts on haul roads. The applicant is in compliance with the spacing requirements, with the exception of the first 3300 feet of the haul road. The Division has granted a variance from the requirements of rule 4.03.1 (4 )(e)(vi) for this road segment. The decision was based on the following facts presented in the application:
