Ave <br />Suite 200 <br />Denver, Colorado 802342728 <br />~~~~i11L~3 <br />PIt~~J 2 6 2v~ <br />RE: Lease of Joe Wright Reservoir Water, Substitute Supply Plan DMG M-79-097 <br />Deaz Mr. Raines, <br />From your request, I understand that you wish to lease 49 acre-feet of water to meet replacement <br />requirements for the East Rigden Pit sand and grave] mining operations. <br />The City of Fort Collins will rent 49 acre-feet of fully consumable water to Lafarge for one yeaz, <br />with the following conditions: <br />The water will be from Joe Wright Reservoir and may only be available during <br />times that water is routinely released through the outlet works. Because Joe <br />Wright is at about 10,000 feet in elevation, the operation of the outlet works is <br />limited during most of the winter and spring months. In certain cases, reusable <br />effluent may be used to meet plan obligations if approved by the Water <br />Commissioner. <br />2. The water will be released at the discretion of the Water Commissioner upon <br />consultation with the City. <br />3. The rental price will be at the rate set by the City of For[ Collins City Council <br />eazly each spring. <br />We will contact you in the spring to inform you of the current price. All releases witl be <br />coordinated through the Water Corunissiorer and me.
