Ave., Suite 900 <br />Denver, CO 80205 <br />RE: Hawk's Nest Coal Silo Reclamation Project <br />Dear Mr. Nondorf: <br />OF ~~ <br />ti~ <br />.~ ; <br />~ re 16 <br />Roy Romer <br />Governor <br />Michael B Long <br />Dwrsion Director <br />Per our conversation today, I will clarify the memo sent to you on <br />December 1, 1993. <br />The Division certifies that the Hawk's Nest Coal Silo Reclamation <br />Project exceeds available funds. The Division utilized the <br />reclamation cost estimating program to determine that the cost of <br />completing the remaining work exceeds available funds by almost <br />$50,000. Remaining work to be completed on site include removal <br />and disposal of the coal material, topsoil replacement, <br />revegetation and sealing 20 degasification drill holes. Based on <br />the detailed cost estimate performed for the items above, the <br />Division certifies that the project exceeds available funds. <br />The Division met with Steve Brown of the Attorney General's Office <br />on December 1, 1993. Mr. Brown reviewed the Right of Entry <br />agreement drafted by the Rio-Grande Railroad to determine if any <br />content of the agreement could possibly be altered. Mr. Brown <br />stated that it wouldn't surprise him if the Rio Grande Railroad <br />refused to change the agreement because it is a standard agreement <br />used by the Rio Grande for projects in proximity to their railroad <br />tracks. <br />If I can be of further assistance, please do not hesitate to call. <br />Sincerely, <br />s ~~~-~- <br />X Erica S.
