<br /> <br />was dry, now it is flowing. Please clarify what you think the <br />problem is and what you would like the Division and/or MCC to <br />do. <br />5. During the inspection on August 29th, the damage to the cabin <br />was examined. The damage includes a cracked footer, gaps <br />between the footer and the pad in some areas of the cabin, <br />exterior doors that stick, damage to dry wall tape, and a <br />cracked bathroom toilet. You have noted some additional <br />damage in your letter dated September 18, 1995, which includes <br />"a gap at the front of the cabin on the north end between the <br />footer and the building and a hump in the floor of the <br />hallway". In addition, you have expressed some concern about <br />whether the water lines which supply water and radiant heat <br />for the building may have been cracked. It appears that <br />subsidence has impacted your cabin. Please be aware that <br />subsidence may not be complete. Residual settling may occur <br />which would affect repairs done now. MCC must promptly <br />repair, rehabilitate, restore, or replace the damaged cabin or <br />compensate you in the full amount of the diminution in value <br />resulting from the subsidence. The Division will ensure that <br />MCC continues to comply with the regulations. If the work to <br />date has not achieved this result, additional work will be <br />required. It is our understanding that MCC and you are <br />working towards this end, and we will monitor the progress. <br />We are aware that you are not satisfied with the repairs. The <br />Division will plan on inspecting the cabin during our regular <br />monthly inspection which will occur this week and report the <br />findings to other Division personnel. <br />6. It is the Division's understanding that Mr. Every and Mr. <br />Mautz had previously agreed to have the repairs completed by <br />September 17, 1995. The Division understands you attempted to <br />push up the date by which the repairs would be completed to <br />September 6, 1995, due to the presence of a film crew. MCC <br />was not able to work with this new deadline. We understand <br />that MCC completed the repairs as detailed in their letter <br />dated September 6, 1995, by September 13, 1995. You wrote in <br />a letter dated September 15, 1995 that you had gone to look at <br />the repairs on the evening of the 13th and were not satisfied <br />with the work that had been done. As stated previously, the <br />Division will inspect the repairs this week and report the <br />findings to other Division personnel. <br />7. The Division cannot require MCC to maintain a snowmobile trail <br />around the fan. <br />8. The Division cannot address loss of revenue issues. <br />
