In response to your complaint, I conducted an inspection
on August 29, 1995 with Mr. Mautz and Norm Every representing MCC.
The focus of the inspection on August 29th, was to investigate the
concerns you have regarding MCC's operation and possible impacts to
your property. A copy of the inspection report has been forwarded
to you under separate cover. Your letter identifies eight, issues.
This letter will respond to the eight issues.
1. The Division understands the problems associated with the Lone
Pine Road from the fan facilities to your property are:
* The slide below the cabin, which blocks the road.
* An area where springs that flow across and down the
road have made the road muddy.
* The section of road where four culverts were
installed. The upper culvert is blocked and the grade of
the road needs to be improved.
* The Swale constructed across the road for the upper
diversion ditch at the Lone Pine refuse pile was made too
deep.
Please refer to the inspection report regarding my
observations in each of these areas. It is the Division's
understanding based on conversations with Mrs. Mautz and Mr.
Every since the inspection, that MCC has offered to assist you
in clearing the slide which blocks the road below the cabin.
At this time the Division cannot determine whether the slide
that blocked the road is localized and due to the wet spring
or if it is more extensive and perhaps due to mining. The
Division will look at the extent of the slide when aerial
photographs of the area are taken this week.
III IIIIIIIIIIIIIIII
sss
