Objections to application and Petition for Hearing The Town of Rockvale gets the water needed to supply the Town and its residents from a water system drawing water from Oak Creek both surface and subsurface flow. The greater part of the water comes from subsurface flow and is collected in a series of wells connected by pipeline. The water right was adjudicated in the District Court in and for Water Division No. 2 in Case No. W1556 on August 9, 1974 for 180 gallons per minute and by Decree of the Fremont County District Court, February 3, 1894. This water right depends on the surface and subsurface flow of Oak Creek and its tributaries. The proposed mining operation by Twin Pines Mines in the SW 1/4 of the NW 1/4, Sec. 1 and the SE 1/4 NE 1/4 Sec. 2 T.20S., R70W is in the Oak Creek drainage basin and could affect the acquifer from which Rockvale's water supply comes. The Town of Rockvale objects to the granting of the permit applied for at this time and petitions for a hearing on the appli- cation and on these objections. The objections are based on the following grounds: 1. Applicant has not filed a copy of its amended application with the County Clerk and Recorder of Fremont County, Colorado, so objector cannot determine what provisions, if any, are made to pro- tect Rockvale's water rights both as to volume and purety. 2. Applicant has not published the notice for four succes- sive weeks as required by statute. 3. The date (April 25, 1979) for filing objections is incor- rect. 4. No provision for protecting Rockvale's surface and sub- surface water right as to quantity and purety has been made and as
