Permit Number CO-0071, 7/84 <br />Page 10 of 10 <br />,~- <br />~- ~ ATTACHMENT C <br />Federal Speclal Conditions <br />Condition No. 1 <br />Within 30 days of permit issuance, the permittee shall implement the <br />mitigation measures identified by the U.S. FWS in its draft biological <br />opinion dated July 9, 1984, and submit proof of such compliance to the <br />regulatory authority and the OSH. Compliance shall be a contribution of <br />X1390.00 (one thousand three hundred and ainety dollars and no/100 <br />dollars) to the Upper Colorado River Fishes Conservation Fund <br />administered by the U. S. FWS. <br />Condition No. 2 <br />Within 90 days of permit issuance, the permittee shall develop for <br />regulatory suthorlty approval a plan of augmentation for flows lose to <br />the surface water system as a result of mine workings inundation. This <br />plan will at a minimum contain volumes of eater needed and methods <br />expected to be utilized so as to minimize harm to downstream water <br />users' rights. <br />Condition No. 3 <br /> <br />~-i At such time that OSM, in consultation with the State Regulatory Authority <br />`, and the State Historic Preservation Officer, determines that subsidence <br />within the permit area has become a potential impact to the cultural <br />resource base o£ the area, additional cultural resource studies may be <br />required. This determination will be based on information derived from <br />the subsidence monitoring program conducted during the life of the <br />mine. A clear justification for additional studies will be presented <br />to the permittee. <br />
