<br /> The Review Process
<br /> GEX Colorado, Inc . submitted an application for the Roadside and Cameo Mines
<br /> on February 17, 1981 , pursuant to Section 34-33-109 of the Colorado Surface
<br /> Coal Mining Reclamation Act. GEX Colorado, Inc . published a notice of the
<br /> filing of an application during the period of March 8 through 29, 1981 .
<br /> The preliminary adequacy review letter which identified deficiencies in the
<br /> original application was sent to the applicant on April 27, 198) . Resolution
<br /> of these deficiencies was required in order of the Division to make
<br /> determinations of compliance with the Act . The applicant responded to the
<br /> comments on October 30, 1981 .
<br /> On December 31 , 1981 , the Roadside and Cameo Mines were purchased by
<br /> Powderhorn Coal Company (PCC) . On January 15, 1982 , the permit application
<br /> was amended to include information on additional federal coal leases which
<br /> were obtained by Powderhorn Coal Company. Following the review process for
<br /> the initial permanent program permit application, the Division issued a permit
<br /> with stipulations on January 3, 1983.
<br /> On November 9, 1984, Powderhorn Coal Company submitted plans for a permit
<br /> revision to construct two new coal processing waste embankments to be located
<br /> North (CRDA No. 2) and West (CRDA No. 3) of the Cameo refuse pile. This
<br /> revision was approved on March 11 , 1985.
<br /> In October 1986, Powderhorn Coal Company notified the Division of temporary
<br /> cessation of operations at the Roadside and Cameo Mines . In early 1987 ,
<br /> Peabody Holding Company purchased the inactive Roadside and Cameo Mines . On
<br /> July 6, 1987, the Division received an application from Powderhorn Coal
<br /> Company for permit renewal . In December 1987, the Division issued a proposed
<br /> decision to renew Powderhorn ' s existing permit.
<br /> On April 20, 1989, Powderhorn Coal Company (PCC) notified the Division of its
<br /> intent to emerge from temporary cessation status on May 1 , 1989. The mine
<br /> resumed operations , producing 140,000 to 190,000 tons of clean coal per year .
<br /> On March 27, 1992 , 270 days prior to expiration of the permit on
<br /> January 3, 1993, the Division sent Powderhorn notification that a permit
<br /> renewal application must be submitted 180 days preceding expiration of the
<br /> permit. Powderhorn Coal Company submitted a complete permit renewal
<br /> application on July 1 , 1992. The application was deemed to be complete on
<br /> July 10, 1993. Public notice was published in the Daily Sentinel on
<br /> August 9, 16, 23, and 30, 1992 . Copies of the application were filed with the
<br /> Mesa County Clerk and Recorder ' s Office , Mesa County Courthouse, and at the
<br /> Division offices at 1313 Sherman Street, Room 215, Denver, Colorado. No
<br /> public comments were received by the Division . After initial review, the
<br /> Division of Minerals and Geology (DMG) notified Powderhorn of adequacy
<br /> concerns on October 29, 1992. On November 12 , 1992 , the DMG met with several
<br /> representatives of Powderhorn to clarify DMG' s concerns . On January 14, 1993,
<br /> PCC again met with DMG to verify the concerns identified by the Division . DMG
<br /> received responses from PCC addressing most of the Division' s concerns on
