Proposed Decision <br /> The Colorado Division of Minerals and Geology proposes to approve with <br /> stipulations an application for renewal of a valid existing permit. <br /> The application was submitted by Powderhorn Coal Company for the Roadside and <br /> Cameo Mines . This decision is based on a finding that the operations will <br /> comply with all requirements of the Colorado State Program as found in the <br /> Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq . , and <br /> the Regulations promulgated pursuant to the Act. If no request for a formal <br /> hearing is made within thirty (30) days of the first publication of the <br /> issuance of this proposed decision , then this decision becomes final . The <br /> permit application, all supporting documentation and any stipulations or <br /> conditions will become a binding part of the permit. <br /> The following stipulations are proposed for the renewed permit. Stipulation <br /> Nos . 1 , 2 6 and 7 were included on the previous permit and are retained here . <br /> Stipulations 11 and 12 are being added with this renewal . <br /> STIPULATION NO. 1 <br /> SIX MONTHS PRIOR TO BACKFILLING THE CAMEO DECLINE, THE PERMITTEE MUST <br /> SUBMIT A PLAN FOR DISPOSAL OF COAL PROCESSING WASTE IN THE CAMEO DECLINE <br /> TO THE DIVISION FOR APPROVAL. THIS PLAN MUST INCLUDE A DISCUSSION OF THE <br /> PROJECTED EFFECTS OF DISPOSAL AND A RECLAMATION PLAN FOR THE DECLINE. <br /> STIPULATION NO. 2 <br /> THE PERMITTEE SHALL SUBMIT TO THE DIVISION AN ANNUAL REPORT OF INFLOWS, <br /> DISCHARGES AND CONSUMPTION OF WATER WITHIN THE MINE. THIS REPORT IS TO <br /> INCLUDE A MINE WORKINGS MAP SHOWING THE LOCATION AND QUANTITY OF INFLOWS; <br /> A TABLE KEYED TO THE MINED MAP WHICH SHALL CONTAIN THE SOURCE (I . E. , <br /> FAULTS, FRACTURES, ETC. ) , QUANTITY, DURATION , AND QUALITY (pH , ELECTRICAL <br /> CONDUCTIVITY, AND TEMPERATURE) OF ALL INFLOWS; A TABLE CONTAINING RECORDS <br /> OF WATER DISCHARGED FROM THE MINE, CONSUMED IN THE MINE AND IMPORTED FOR <br /> USE WITHIN THE MINE; AND A DISCUSSION OF THE WATER BALANCE IN THE MINE. <br /> STIPULATION NO. 6 <br /> IF THE FIELD TRIALS CURRENTLY BEING CONDUCTED AT THE ROADSIDE COAL <br /> PROCESSING WASTE EMBANKMENT DEMONSTRATE THAT REVEGETATION SUCCESS <br /> CRITERIA CANNOT BE MET BY LESS THAN FOUR FEET OF NON-TOXIC, <br /> NON-COMBUSTIBLE COVER AND/OR THAT DISTURBANCE TO THE HYDROLOGIC BALANCE <br /> IS NOT MINIMIZED WITH LESS THAN FOUR FEET OF COVER, THE PERMITTEE WILL BE <br /> REQUIRED TO PLACE FOUR FEET OF THE BEST AVAILABLE NON-TOXIC <br /> NON-COMBUSTIBLE COVER OVER THE ROADSIDE REFUSE PILE AND CAMEO NOS. 1 , 2 , <br /> AND 3 REFUSE PILES. <br /> STIPULATION NO. 7 <br /> A PERFORMANCE BOND IN THE AMOUNT OF $672 ,529 .00, PAYABLE TO THE STATE OF <br /> COLORADO AND THE OFFICE OF SURFACE MINING, MUST BE FILED WITH THE <br /> DIVISION PRIOR TO CONSTRUCTION OF CAMEO REFUSE AREA NO. 3. <br />
