In response to your letter of September 30, 2005, trose County Staff have reviewed
the file and associated proceedings for the S 'al Use Permit for Nick Gray Pit #1 (SU-
01-0159). There isCo record in this file that ndicates any amendment to the Special Use
Pennit that was ongtnally approved in January of 2002. The size of the site allowed by
this Special Use Permit is 9.95 acres.
Any expansion of the site area would require an application for a revision of the approved
Special Use Permit pursuant to Section VI. H. 1., Montrose County Zoning Resolution. A
prior understanding of this process was demonstrated by Mr. Gray's Representative
Michael Ripp during the January 22, 2002 Boazd Meeting at which the Special Use
Permit was approved. The following is an exact quote taken from the written transcript of
that meeting.
Mr. Ripp: "I also heard Adele ask if, about can this be expanded from a ll0 to a 112.
And, certainly it can. We have no plans to do that. But, in order to do that
we would have to come back through the whole process including the
County, including the State, and everything else. So, you know, that just
starts the whole thing over again."
Please contact this office when you aze ready to proceed with the application for the
proposed expansion from the current approved 9.95 acre pit.
