AF 1-300-14 and AF 1-300-17 Gentlemen: This letter is to request that the Mined Land Recla- mation Board consider at it's February 23 meeting a request by W.R. Grace & Co. and H-G Coal Company that the Board approve the transfer of Permit No. 77-99 from W.R. Grace & Co. to H-G Coal company; and thereupon release Grace from all of it's liability under Permit No. 77-99 and release Grace's surety, Seaboard Surety Company, from liability under Bond No. 844948. H-G Coal Company, the successor operator, will assume all responsibility and liability for the reclamation of. all lands previously mined and not reclaimed under Permit No. 77-99 and Bond No. 844948. Enclosed is a copy of portions of the Articles of'Partnership of H-G Coal Company, a Delaware general partnership, in which the general partners are Coalgrace, Inc., a Delaware corporation and a wholly owned subsidiary of W.R. Grace & Co., and Hanwest, Inc., a Delaware corporation and a wholly owned subsidiary of the Fianna Mininq Company. The enclosed portions of the Articles of Partnership concern the management of the partnership and decision-making authority on behalf of the partners. Also enclosed are letters to the partnership from Hanwest, Inc. and Coalgrace, Inc. designa- ting their "agents", as that term is defined in the Articles of Partnership.
