Long <br /> <br />Re: Response to Citizen's Request for Inspection; Division Director <br />Basin Resources, Inc.; The Golden Eagle 1~Tme, Permit No. C-81-013; <br />The New Elk Mine, Permit No. C-81-012 <br />Dear Mr. Tatum: <br />On November 9, 1994, the Division received your letter dated November 3, 1994 regarding the <br />Golden Eagle and New Blk Mines operated by Basin Resources, Inc. Thank you for bringing <br />your concerns to our attention. We would like to provide our response. <br />Your letter indicates three concerns. The first appear; to be a concern with possible violations of <br />the air emissions permits issued to Basin by the Air Pollution Control Division of the Colorado <br />Department of Public Health and the Environment. The second appears to be a concern with <br />possible violations of the Coloado Pollutant Discharge System (CPDS) pern3its issued to Basin by <br />the Water Quality Control Division of the Coloredo Department of Public Health and the <br />Environment. The third appears to be concerns with noise from both the trucks operated by <br />Savage Company to transport coal along Colorado State Highway 12, and from the mine's <br />"blowers. " <br />Concerns with possible violations of the air emissions permits should be directed to the Air <br />Pollution Control Division of We Colorado Department of Public Health and the Environment: <br />Their address is 4300 Cherry Creek Drive South, Building B, Floor 1, Denver, Colorado 80222. <br />Their telephone number is (303) 692-3100. <br />Levels of noise emitted by mining operations are not regulated by our Division. A'e suggest that <br />you contact Mr. Michael A. Ossola, Director, Ias Animas County Planning and Land Use Office <br />or the County Health Department. His telephone number is (719) 846-4486. <br />VJe were in the process of conducting a reguL3r monthly inspection at the Golden Eagle and New <br />Elk mine sites when we received your letter. We therefore contacted our inspector and, on <br />November 10, 1994, he investigated your concern regarding the placement of a "white foamy <br />substance" into Sedimentation Pond 004 at the New Elk Mine. The inspector found that drilling <br />mud had been placed in Sediment Pond 004. The inspector checked all the other ponds at the <br />
