Operations on Lands Subject to Limitations or Prohibitions - Rules <br />~~ ~~ ~ <br /> <br />The proposed operation is in compliance with the requirements of Rule <br />2.07.6(2)(d) for the following reasons: <br />The permit area of the proposed operation is not within: <br />a. An area designated unsuitable for mining; <br />b. An area under study for designation as unsuitable for mining; <br />c. Any lands subject to prohibitions or limitations. <br />The proposed permit boundary includes several thousand feet of Garfield County <br />Road 335 or is within 100 feet of the outside right-of-way of this public <br />road. In addition, portions of this road are to be used as a coal haul road <br />temporarily. The operator must demonstrate that the necessary requirements of <br />Rule 2.07.6(2)(d)(iv) have been met. Therefore the following information is <br />required to make a finding of compliance: <br />Requirement No. 14 <br />THE APPLICANT MUST DEMONSTRATE THAT THE NOTICE AND APPROVAL <br />REQUIREMENTS OF RULE 2.07.6 (2)(d)(iv) FOR GARFIELD COUNTY ROAD 335 <br />HAVE BEEN MET PRIOR TO PERMIT ISSUANCE. <br />The proposed permit boundary also includes or is located within 300 feet of an <br />occupied dwelling. The operator must submit waivers from each owner of such <br />dwellings. Therefore the following information is required to make a finding <br />of compliance: <br />Requirement No. 15 <br />THE APPLICANT MUST SUBMIT WRITTEN WAIVERS ALLOWING SURFACE ACTIVITIES <br />FROM ALL OWNERS OF DWELLINGS WITHIN 300 FEET FROM OR INCLUDED WITHIN <br />THE PERMIT BOUNDARY. <br />The applicant has not submitted all necessary maps with proper certification, <br />therefore the following information is required for Division approval of the <br />permit application: <br />Requirement No. 16 <br />1) THE APPLICANT MUST PROPERLY CERTIFY FIGURES 2.1-1, 2.1-2, 2.1-3, <br />2.1-4, 3.1-1, 3.1-2, AND 3.1-3. <br />2) THE APPLICANT MUST ADD THE SEAL AND P.E. NUMBER OF SAM S. ARENTZ TO <br />FIGURES 3.3-6, 3.3-7, 4.2-1, AND 4.2-27 OR PROPERLY RECERTIFY THESE <br />FIGURES. <br />
