Box HH <br />Hayden, CO 81639 <br />Re: Responses to Permit Revision Stipulations PR1 and PR2 and <br />Division Review, Hayden Gulch Mine (Our File C-003-80) <br />Dear Mr. Schoenfelder: <br />I have completed my review of your submittals for permit revision stipulations <br />PR1 and PR2. <br />Stipulation PR1 required a p]an to address potential erosion in a section of <br />the reclaimed area (adjacent to the intersection of N 378,000 adjusted and <br />E 1, 498,000 adjusted). Our review has indicated that the measures proposed <br />are adequate to satisfy the stipulation, and will be incorporated into the <br />permit. <br />Stipu]ation PR2 required reca]cu]ation of the reclamation bond in light of the <br />altered mining plan for the Hayden-Gulch Mine. Independent calculation of the <br />bond by the Division yielded a value of $2,357,767.00, compared to the <br />calculation of $2,122,266.00 computed by Yampa Mining Company. Currently, the <br />amount of bond in effect is $2,223,313.00. The Division requests that Yampa <br />Mining Company/H-G Coal Company increase the amount of the reclamation bond to <br />reflect the Division's calculated figure. For your convenience, I have <br />enclosed copies of the Division's corporate surety forms, if needed. Many <br />surety companies increase amounts of reclamation bonds through riders to the <br />current policy, this is acceptable to the Division. <br />If you have any questions, please feel free to contact me. <br />Sincerely, <br />~~'~~~~- <br />Michael S.
