Land Use -Rules 2.04.3, 2.05.5, and 4.16 <br />Pre-mining land use in the area of the New Elk Mine consisted of cropland, <br />rangeland, and wildlife habitat, as determined by the Las Animas County Zoning <br />Board. <br />The applicant has proposed a post-mining land use of rangeland and wildlife <br />habitat for all new areas of surface disturbance covered under this permit <br />revision. <br />This proposed land use is consistent and compatible with adjacent land uses <br />and is attainable through the proposed reclamation plan. Pursuant to <br />2.01.6(2)(1), the Division hereby approves the proposed post-mining land use <br />of the operation. It is determined that rangeland and wildlife habitat meet <br />the requirements of Rule 4.16. <br />The proposed operation is in compliance with the requirements of this section. <br />III. Cultural and Historic Resources -Rules 2.04.4 and 2.05.6(4 <br />The cultural and historic resources inventory that was conducted on the area <br />of the proposed surface facilities is discussed on pages III(6) through <br />III(11) of the revision application. This information has been reviewed by <br />the Division for compliance. <br />Based on cultural resource inventories supplied by the applicant and review by <br />the State Historic Preservation Officer, it has been determined that no <br />cultural and historic resources listed on the National Register of Historic <br />Places have been identified within the area of the proposed surface <br />facilities. <br />Pursuant to Rule 2.07.6(2)(e), the Division finds that the mining operation <br />Nill not adversely affect any publicly owned park or place listed on the <br />National Register of Historic Places. <br />The proposed operation is in compliance with the requirements of this section. <br />IV. Geology - Rules 2.04.5 and 2.04.6(1) <br />Information on geology of the proposed refuse disposal area can be found in <br />Section III, Part 3 of the permit revision application. <br />A general description of the geology of the mine site can be found in the <br />Description of the Environment and the Probable Hydrologic Consequences and <br />Cumulative Hydrologic Impacts Study section of this findings document. <br />The proposed operation is in compliance with the requirement of this section. <br />V. Hvdrolooic Balance: Surface Water - Rul <br />Information on quantity and quality of surface water for the permit revision <br />area can be found in Section III, Part 4 and Exhibit II, 2-2 of the permit <br />revision application.
