<br />STATE OF COLORADO <br />MINED LAND RECLAMATION BOARD <br />;\ <br />DEPARTMENT OF NATURAL RESOURCES s.`.; ~C~ ~' <br />IN THE MATTER OF: Landowner's Request for ~~,~`~~~ BOARD <br />Reclamation Schedule, ~`~~1 ORDER <br />The GEC Strip Mine <br />Revoked Permit No. C-81-037 <br />T0: The Corley Company and all other persons engaged in or owning <br />or controlling the property upon which lies the former GEC Strip <br />coal' mining operation located in portions of Sections 24 and 25, <br />Township 20 South, Range 70 West, and portions of Sections 19 and <br />30, Township 20 South, Range 69 West, of the 6th P.M., in Fremont <br />County, Colorado. <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined <br />Land Reclamation Board by C.R.S. 34-33-101 et. seq., the Board <br />hereby makes the following findings of fact: <br />1. On August 25-26, 1993, the Board held a Formal Public <br />Hearing to consider a petition from Dr. W.D. Corley, Jr. and <br />the Corley Company ("Corley") for the establishment of a <br />schedule of the activities associated with the reclamation <br />of the GEC Minerals, Inc. GEC Strip Mine, Revoked Permit No. <br />C-81-037. <br />2. Corley presented evidence and/or testimony at the Formal <br />Hearing that: <br />a. Corley was the lessee of the property upon which GEC <br />Minerals, Inc. operated the GEC Strip Mine from 1975 to <br />1983; <br />b. The Colorado Mined Land Reclamation Division ("the <br />Division") permit issued to GEC Minerals was <br />subsequently revoked, and the associated performance <br />bond forfeited in 1987; <br />c. The Division is scheduled to begin reclamation of <br />certain GEC Minerals disturbance in Section 24, T20S, <br />R70W, in September, 1993; <br />d. Reclamation of the area in Section 30, T20S, T69W known <br />as the East Pit has yet to begin; <br />e. Monies from the forfeited GEC Minerals performance bond <br />that would remain following the reclamation scheduled <br />for Section 24, T20S, R70W would be insufficient to pay <br />for backfilling completely the East Pit with material <br />from the adjacent material stockpile known informally <br />
