The objective of the S is to
identify sources of stotmwater pollution and then implement Best Management Practi s to control
those soutrxs. If a discharge of stormwater leaves the site without implementation of a SWMP or
without the acquisition of a stormwater discharge permit, it is a violation of the Colo do Water
Quality Control Act and is subject to enforcement action by the Water Quality Contro Division. The
Colorado Water Quality Control Act authorizes both civil and criminal penalties for willful non-
compliance.
Potential Exemptions
If a stotmwater permit is not applicable to this operation, please send us a letter detail ~ g the basis for
this, by the above deadline. Two potential exemptions aze available. If all runoff fro the mine site
is contained on the site, with no discharge off site, a stormwater petmit is not requir Bond release
from the site's MLRB reclamation permit is another acceptable basis for exemption.
If there are any questions regarding the stormwater program, please give me a call at ((303) 692-3606.
Sincerely,
Daniel M.
