/~ <br />T <br />• <br />Midterm Review <br />Eckman Park, Mine 1, ana Mine 2 <br />(C-81-071) <br />This document Gresents the results of the Division's Midterm Review of the <br />Colorado Yampa Coa] Company, Eckman Park, Mine 1, and Mine 2 Complex. This <br />Midterm Review was conducted to fulfill the requirements of Rules 2.08.3, <br />2.06.2(TO), 2.06.3(4), 2.06.5(3), 2.06.7(5), ana 3.02.2(4). <br />Rule 2.08.3 requires that the Division conduct a review of each permit issued, <br />prior to its midterm (2-1/2 years). Based on this review, for good cause <br />shown, the Division may require reasonable revisions or modifications of the <br />permit provisions to ensure compliance with the Act and Regulations. <br />Rules 2.06.2, 2.06.3, 2.06.5 and 2.06.7 require that experimental practices, <br />mountaintop removal variances, variances from approximate original contour <br />(AOC), ono variances from contemporaneous reclamation, respectively, be <br />reviewed by the Division where applicable curing the midterm review. <br />Rule 3.02.2(4) requires that the Division review the amount of the bond and <br />the terms of acceptance of the bona every 2-]/2 years. <br />This midterm review consisted of a detailed review of the Eckman Park, Mine i, <br />and Mine 2 permit application ana Findings Document to identity any items that <br />may have been overlooked during the initial review. The Division also <br />reviewed al) subsequent revisions and stipulation responses to ensure that all <br />permit commitments and conditions were being followed. Hydrologic monitoring <br />data was reviewed in conjunction with the review of the application to assess <br />the adequacy of the monitoring plan and discussion of hydrologic impacts. <br />Problems and observations from past inspection reports were also considered. <br />Section I - History <br />Colorado Yampa Coal Company (CYCC) currently operates the Eckman Park, Mine 1, <br />and Mine 2 complex under Permit Nurtber C-81-071. The original approval <br />document for this operation was granted to Energy Fuels Corporation (previous <br />owner) on March 25, ]980. The original permit number was 79-1~7, and the <br />approval was based on the Office of Surface Mining's (OSM) February, 1980 <br />approval with stipulations for a major modification to the Surface Mining and <br />Reclamation Plan for Energy Fuels Corporation's Mine 1, Mine 2 and Extension <br />Into Eckman Park. The associated Technical Environmental Analysis (TEA) <br />prepared by the OS~4 was adopted by the Mined Lano Reclamation Division <br />(Division) as part of the approval document. <br />In conjunction with the previously approved TEA, an addendum 4Jas prepared in <br />response to a technical revision (dated September, 1985) to the permit. The <br />aodenaum updated the status of the operation ana documented compliance with <br />the Act. for administrative purposes, the Division subsequently issued Permit <br />No. C-81-071 to CYCC for Eckman Park, Mine 1, and Mine 2. <br />
