<br />/~ ~ \\ / <br />December 22, 2003 <br />To whom it may concern: <br />During 2004, Oxbow Mining, LLC (OMLLC), has activities planned that may possibly require <br />surface blasting. Such blasting will typically be limited to the excavation of rock to facilitate <br />miscellaneous construction activities. Construction activities may occur throughout 2004. <br />Pursuant to the provisions of Rule 4.08.3 of the Regulations of the Colorado Mined Land <br />Reclamation Boazd, OMLLC published the attached 2004 Blasting Schedule in the Delta County <br />Independent on December 10, 2003. <br />n~ <br />._~\ <br />~~~vV~ <br />~~ <br />Additionally, Rule 4.08.2(1) of the Colorado Mined Land Reclamation Board for Coal Mining, states <br />in part: <br />"At least 30 days before initiation of blasting, the operator shall provide written <br />not cation to all residents or owners ofdwellings or otherstructures located within <br />one-ha f mile of the permit area which explains how to request apre-blasting <br />survey. Upon request to the Division by a resident or owner of a dwelling or <br />structure that is located, ... in the case of surface blasting activities incident to <br />underground mining activities, within one-half mile of such blasting activity, the <br />person who conducts surface or underground mining activities shall promptly <br />conduct apre-blasting survey of the dwelling or structure and promptly submit a <br />report of the survey to the Division and to the person requesting the survey. If a <br />structure is renovated or added to, subsequent to apre-blasting survey, then upon <br />request to the Division a survey of such additions and renovations shall be <br />performed in accordance with 4.08.2" <br />If you aze a resident or owner ofdwellings or other structures located within one-half mile of the <br />blasting activity described in the attached 2004 Blasting Schedule, you may request apre-blasting <br />survey by contacting the Colorado Division of Minerals and Geology (CDMG), 1313 Sherman <br />Street, Room 215, Denver, Colorado 80203, Phone: (303) 866-3567 or contacting OMLLC at P.O. <br />Box 535, Somerset, Colorado, 81434. Upon a request to the CDMG or OMLLC by a resident or <br />owner of a dwelling or structure that is located within one-half mile of the described area, OMLLC <br />will promptly conduct apre-blasting survey of the dwelling or structure. <br />You have been sent this notification based on our current mailing list. If you are no longer an owner <br />or resident in the azea, or if you know of someone we should have contacted, please ]et us know.
