The permit <br />revision application was revised for three reasons: 1) to include the <br />responses to adequacy questions that arose during the permit revision review, <br />2) to separate the Foidel Creek Mine application from the Energy Nos. 1, 2 and <br />Eckman Park application, Permit No. 79-177, and 3) to transfer the permit <br />rights from Colorado Yampa Leasing Company to Twentymile CDaI Company. <br />The adequacy responses have been satisfactorily incorporated into the permit <br />application. TCC has made those changes that were discussed and approved by <br />the Division during the permit revision review. <br />In order to separate the Foidel Creek underground mine from the Energy fJos. 1, <br />2 and Eckman Park mine permit (79-177), TCC incorporated information from <br />Permit No. 79-171 into the Foidel Creek permit application. Thus, the Foidel <br />Creek permit application is complete and addresses these sections of the <br />regulations needed to demonstrate compliance. <br />Since TCC is requesting a transfer of permit rights from Colorado Yampa <br />Leasing Company, as well as a separate permit, the requirements of Rule 2.08.6 <br />are applicable. There are some concerns regarding Rules 2.08.6(2) and <br />2.08.6(5). For Rule .08.6(2), TCC should submit the supplemental information <br />Q,C required by Rule 2.03 ~(7). Since TCC has requested that the information be <br />~ kept confidential, a confidentiality form is enclosed. Please fill this out <br />4c `~ so that the confidential information will not be placed in the public file. <br />g/~~ Rule 2.08.6(5) states that any successor in interest seeking to change the <br />conditions of reclamation operations or any terms of the original permit shall <br />make application for a revised permit. In the Foidel Creek permit application <br />TCC has revised the land use section and the re vegetation section. These <br />proposed changes in the permit terms will be considered as a technical <br />revision and thus the public notice requirements of Rule 2.08.4(5)(b) are <br />applicable.
